8.            PUBLIC HEARING

 

A.    Proposed Designation of Expanded Highway 38 Northeast Urban Renewal Area and on Proposed Urban Renewal Plan Amendment

 

This public hearing concerns the proposed designation of an expanded Highway 38 Northeast Urban Renewal Area and proposed Urban Renewal Plan amendment. The property in question is bounded on the west by Park Avenue, on the north by Colorado Street, on the east by the easterly line of Weed Park, and the south by the southerly property lines of Weed Park and Muscatine Community College. The proposed amendment to the Urban Renewal Plan makes this property subject to its provisions. The initial purpose of the amendment is to facilitate the use of tax increment financing in support of the development of commercial student housing facilities at Muscatine Community College. Prior to any formal action by City Council, a public hearing is required.

 

Now is the time for the public to comment.

A.    Resolution Approving Designation of Expanded Highway 38 Northeast Urban Renewal Area and Urban Renewal Plan Amendment
 

Presented for City Council’s consideration is a resolution approving the designation of an expanded Highway 38 Northeast Urban Renewal Area and proposed Urban Renewal Plan amendment. B.    Ordinance Providing for the Division of Taxes Levied on Taxable Property in the 2010 Addition to the Highway 38 Northeast Urban Renewal Area
 

Presented for City Council’s consideration is an ordinance providing for the division of taxes levied on taxable property in the 2010 Addition to the Highway 38 Northeast Urban Renewal Area. As part of the previous action approving the designation of an expanded Highway 38 Northeast Urban Renewal Area and Urban Renewal Plan amendment, it is now necessary  to adopt the ordinance providing for the division of taxes levied on the taxable property in the 2010 Addition to the abovementioned urban renewal area.

C.    Resolution Setting Public Hearing on Proposed Development Agreement with A&E Convenience LLC to Include Tax Increment Payments
 

Presented for City Council’s consideration is a resolution setting a public hearing on a proposed development agreement with A&E Convenience LLC to include tax increment payments. The proposed agreement between the city and A&E Convenience LLC concerns the development of a new commercial convenience store, car wash and fuel station facilities in the South End Urban Renewal Area. The agreement will provide for certain financial incentives in the form of incremental property tax payments in a total amount not to exceed $40,000. Prior to any formal action by City Council, a public hearing is required. This public hearing will be held on Thursday, December 16, 2010, at 7 p.m.

D.   Resolution Setting Public Hearing on Proposed Development Agreement with Oxbow Development Corporation

 

Presented for City Council’s consideration is a resolution setting a public hearing on a proposed development agreement with Oxbow Development Corporation. The proposed agreement concerns the development of new commercial student housing facilities at Muscatine Community College in the Highway 38 Northeast Urban Renewal Area. The agreement provides for certain financial incentives in the form of incremental property tax payments in a total amount not exceeding $425,000. These tax payments will be payable solely and only from incremental property tax revenues generated within the Highway 38 Northeast Urban renewal Area.

E.   Resolution Accepting Completed Work for the Clay Street Bridge Improvements and Authorizing Final Payment 

Presented for City Council’s consideration is a resolution accepting completed work for the Clay Street Bridge improvements and authorizing final payment. In July 2010 City Council approved the contract from Hy-Brand Industrial Contractors in the amount of $340,450.53 for the Clay Street Bridge Improvement Project.  Work on the project included removal and replacement of the bridge deck, approach paving, barrier wall and hand railing. In addition, a 16” water main hanging under the bridge was also removed and replaced. There were no change orders. The project has been inspected and found to be in conformance with the plans and specifications. It is staff’s recommendation the work be accepted and final payment authorized to Hy-Brand Industrial Contractors.

F.    Resolution Accepting Completed Work for the 2009 Street Improvement Project and Authorizing Final Payment 

Presented for City Council’s consideration is a resolution accepting completed work for the 2009 Street Improvement Project and authorizing final payment. In April 2009 City Council took action to approve a contract with Illowa Investments in the amount of $2,557,601.61 for the 2009 Street Improvement Project; however, their total project cost was $2,903,688.41. The original estimate for city streets was $1,830,134.05 with the final cost being $1,889,041.75. For the Greenwood Cemetery roads, the original estimate was $402,065.62. Due to the numerous problems encountered, the final cost was $609,466.26. In the Downtown TIF District, the original estimate was $544,912.65 with the final cost being $405,180.40. The project work has been completed and approved and it is staff’s recommendation the work be accepted and final payment authorized to Illowa Investments Inc.

At this time Greg Jenkins of the Greater Muscatine Chamber of Commerce & Industry will review with Council a proposed jobs retention project involving Bridgestone Bandag LLC.
